Is it possible to hide in the army from court for bribes — what the law says.


On July 17, Law No. 4496-IX came into effect, which was signed by the President of Ukraine Volodymyr Zelensky on July 15. The purpose of this law is to strengthen anti-corruption measures. The text of the document was published on the website of the Verkhovna Rada of Ukraine.
What changes have been implemented
According to the new amendments, people accused of committing serious or particularly serious corruption offenses will not be able to join military formations.
What else has changed:
- changed the thresholds of responsibility for false declaration
- reduced the threshold of assets for which liability for illegal enrichment arises;
- clarified the list of officials subject to punishment;
- improved the sequence of cases of NABU and BEB.
As lawyer Bohdan Pulynets commented to OBOZ.UA, this law is not a new code, but rather a package of amendments to the Code of Ukraine on Administrative Offenses, the Criminal Code, and relevant laws on anti-corruption control and military service.
According to him, mobilization will now not protect against prosecution for corruption criminals. If a criminal proceeding is initiated, the lawyer must prove that the accused cannot participate in the hearings due to direct involvement in defense activities.
'Individuals against whom serious or particularly serious corruption crimes are being considered in court cannot be admitted to the Armed Forces of Ukraine. 'To be mobilized under a sentence' to avoid court in such categories is practically impossible,' — concluded the lawyer.
He also added that it is possible to be conditionally released to serve, but this privilege is not available to those convicted of particularly serious corruption crimes. The court will make decisions regarding other corrupt officials.
Recall that on July 15, President of Ukraine Volodymyr Zelensky signed a law enhancing responsibility for corruption offenses. The anti-corruption system is expected to become more effective after the changes are implemented.
